Although the marshal on the left here does seem to be waving a green flag before the overtake:

Honestly don't think that this is the overtake that they need to be looking at. I was watching it on Sunday on Sky and they played a part of the race going onto the straight of the start finish line and they showed that he overtook Kobayashi I think under a yellow flag. The footage was very clear that it was under a yellow flag and that should be what the FIA look at.

Nope, that was a yellow & red flag. Sky said that afterwards.

Anyway, the FIA have said that there is 'no case to answer' so nothing is going to happen

I always doubted anything would happen. Something as obvious as an illegal overtake wouldn't take what, three, four days, to be complained about.
